    Default Convictions

    If I get convicted for a retail fraud (misdimineor) and I am not a U.S. citizen, but I am in the states in legal status, no prior convictions or anything, what are the probabilities that the immigration office will find out and what are the chances for a deportation?

    It's impossible to guess at the odds that the BCIS will discover your conviction. However, typically, a misdemeanor offense won't trigger deportation unless it is a crime of moral turpitude resulting in a sentence of 1 or more years of confinement.

    Make sure that your defense lawyer is aware of your immigration issues.
