    Default Cop Tresspassing Onto My Property, Searched and He Has No Right

    My question involves police conduct in the State of:

    Massachusettes


    I am 18, i have my own business i run online. im usually doing something for my

    buseness and have no time to do much else. definately not doing some dumb kiddy crimes. so with that in mind. i am

    always biking around, i have nice studded bike tires so the snow and ice are nothing. i was biking down my road and

    noticed a cop sitting at the bottom of the road. so i biked to my garage, as i was getting off my bike and turning

    around i see a cop car entering my driveway my property. he then asked if i was on a certain road. and i actually

    was i took it as a shortcut. so he says some kids did something dumb. he told be my rights and told me to put my

    hands on the car. he searched me kinda like i was some terrorist at a airport. took a herb grinder with weed in it.

    its a 100$ fine for under ounce here. i did not do anything for this illegal search. do i have a case on myPD?

    also im on unsupervised probation for a year for possession of a class e sub. and a charge of posession with intent

    to distribute a couterfeight substance. its been 7 or so months through it. ive done good only business work. and

    do not think this is right. at all. thanks alot

    So far you've told us that you're on probation for possession of drugs and trafficking fake drugs, that somebody apparently saw you do "something stupid" on a road you admit you were on (we don't know what, or whether it would have justified this level of investigation), and that the officer searched you and found you to be in possession of marijuana. By now I assume you know what the "something stupid" was, so please fill us in.

    Does your probation also include search stipulations? In other words, do your conditions of probation contain language that state you are subject to search without consent at most any time? I suspect they do.

    If your attorney believes that you were not subject to search and that the officer's search of your person exceeded a proper Terry frisk for weapons or without any consent or exigency, he or she may move to suppress the evidence.

    Oh, and you say you have "been good" and only engaged in business, yet, here you are still holding dope! How is that "doing good?" Or by that do you simply mean you have not been caught in the last seven months?
