    Default Who Pays for a Rental Car After an Accident

    My question involves insurance law for the state of: Pennsylvania

    Hello, On christmas day my parked car was hit by my cousin. We are both insured with safe auto. I will soon be starting school and work varying hours and will need a rental car while my vehicle is in the shop. First off, the insurence should pay for the rental because the other driver is at fault right? Also i am only 18, will the insurence company be forced to find a way around this so i still get a rental? Thanks!

    Insurance pays only for what the insurance contract requires. If your cousin's insurance will cover a rental for you, you can make a claim through his policy. If you have insurance coverage for a rental, you can claim that coverage through your own policy. But we have no access to the policies, and thus cannot tell you what they will cover.

    OK new problem the insurance told us they would pay for a rental from enterprise, and that i could rent under 18 as long as i had collision. We put collision on my coverage today and went to pick up the rental, and the insurance said they would not insure the rental because the collision was not on at the time of the accident. This was a not at fault accident.

    Why does it surprise you that if you chose not to carry collision insurance at the time of the accident, you don't have collision coverage for the accident?

    Whatever is on the policy on the day of the accident, rules. Adding something after the fact won't cut it. If it wasn't there the day of the accident, it doesn't count.
