    Default Frivolous Litigation

    I can't believe this attorney filed suit against this officer for what he did!

    And countless "gun rights" sites can't believe the court allowed such outrageous conduct by the officer.

    I'm with the plaintiff on this one. He has every right to file suit.

    Sure, he has a right to file suit, but everything I read in the case here seems to indicate the officer did not do anything wrong. So, the case apparently resolved itself as it should have.

    As the saying goes, "Anyone can sue anyone else for anything ... it is winning that can be tough."

    If I saw a guy walking towards a courthouse with a gun - briefcase and suit or not - he'd be held at gunpoint and detained until I could sort the matter out, and I live and work in a very gun FRIENDLY community.

    The issue would be more compelling if the Supreme Court had found, outside of DC, that there was an individual right to bear arms. The gist of the lawsuit seems to be the plaintiff's assertion that a ten minute detention, and the impound of gun and license for verification, were unreasonable.

    If the plaintiff were to prevail, then it sort of renders gun laws moot as the police would be unable to contact and detain armed subjects. It would also potentially do some pretty ugly things to the concept of detentions.

    I cannot imagine that this will go any further.

    And blue, the appellate court affirmed the summary judgment in favor of the city and the officer. Unless the attorney wants to appeal it further, it's done.
