Default Finding a Criminal Defense Attorney

    Hey,
It seems I might be in the same boat as you. CPW4 in NYC subway for a pocketknife. Clean record.
Who was your attorney for this case?
    Do you recommend using him/her?

    Thanks.

Default Re: Defenses to a CPW4 Charge

Choosing an attorney is difficult. Mine was recommended to me by a Friend. But this Attorney was floored regarding how long this case dragged on. It was unbelievable to him, and would not want to go thru the same BS again.
I would hire an Attorney who has Familiarity in these types of cases in your Jurisdiction. Someone who is known to the DAs and the judges etc.
This is a type of case that should not take a Year to resolve. It is an Abomination! The Court System, including the Queens DAs Office and the Judges should be Ashamed of themselves, for letting these types of cases to take up so much of the Courts Time. But like I said, it must be a Case of keeping the Jobs of the people who are invoved with these BS cases.
There was NOT ONE Ounce of Discretion used in the Adjudication of my Case.
Don't be Railroaded into accepting anything less than what would be acceptable to you. I don't know the Background of your case, but if similar to mine, just fight he charges in Court.
If enough people Fight Charges as Idiotic as these, maybe someone will stand up and put a Stop to Such a Waste of Time and Money it takes to Prosecute Charges such as these. Good Luck!

You can ask the lawyer about an acd, which would dismiss and seal the charge in 6 months if you stay out of trouble. A good local lawyer is the best bet. I don't understand either why some case get draged out so long. A pocket knife seems just like a misunderstanding, which would make an acd make sense. Let give this guy another chance b.c he technical broke the law but he no huge harm, having a case drag out for a year is pure bs.

I would say the important issue is to have a candid conversation with a prospective attorney. I cannot comment as to why the case has dragged on for so long, but you should feel comfortable with the individual who is representing your interests.
