    Default Arbitration Without Permission

    My question involves a traffic accident in the State of: Missouri:

    An accident occurred. The investigating officer opined that driver one was at fault for being inattentive. I am driver 2. The officer after interviewing driver 1 did not interview me based on what he learned from her. I checked on status of claim (wanting deductible returned) and was told matter went to arbitration and I was assessed 90% fault. Insurance company said arbitration binding. They were very busy and assigned case to outside company. No-one contacted me, the witnesses nor the officer before the arbitration. No one contacted me that matter was being submitted to arbitration nor told me result. I found out only because I asked for status of claim. I had informed insurance company (prior to arbitration) that if there was at any point blame would be placed on me I would file suit to prove other wise.

    Options?

    This presumably was the arbitration of the claim you subrogated to your insurance company when you settled with your own insurer. Once you subrogate the claim to them it becomes their claim to negotiate, settle, or arbitrate.
