    Default Car-Pedestrian Accident in New York

    My question involves an injury that occurred in the state of: NY

    My mom was hit by a car when she was crossing the road. It was a driver's fault and the police report was taken. She was then taken to the hospital for treatment, tests were taken and a surgery was performed. What options does my mom has?

    Under NY's no fault laws, the driver's insurance pays whether it is his or her fault or not, in car/pedestrian accidents.

    The bills would be submitted to the drivers insurance company to be taken off. Presumably, the driver provided information on his insurance.

    I had a car/pedestrian accident back in 2004 in NYC where I was the driver.

    I just came back from the police precint and they can't find the police report. They checked the logbook and the compter system and they can't the report. But one of the eyewitnesses seen the police officer write the report and even saved his badge number. The desk officer gave me a Report of Motor Vehicle Accident form and told me to send it to their Highway and Road Accidents Department.

    As to not finding the police report, that's happened to me too. Just go back in a few days, and ask for it again. In my case, they found it the second time around. It sometimes take two or three days to get the report through the system.

    If you have the name of the insurance company of the driver, get hold of them right away, and notify them immediately.

    If you have the license plate number, the local police station will provide you the name and adress of the registered owner of the car. My car was sideswipped on the Triboro bridge, the other driver speeded away, I got the plate number, and that's how it was handled.

    I just got the report. There is no insurance company name but there is the name of the driver, address, license plate number, insurance number and VIN. Should I go to a lawyer now (tomorrow) since I've got the accident report?

    Yes, if you want an attorney to handle it, find one and have him or her handle the case.

    But, you can try calling or writing the driver direct, with what you got, and demand payment, from the driver himself, in which case, he or she would in turn transmit your demand over to the insurance. The driver should have notified his insurance by now.

    In my accident case, the pedestrian contacted and received payments from my insurance for his medical bills, then later got an attorney to demand more, so the case dragged on for over three years. I went to a deposition three years after the accident happened.
