My question involves a foreclosure in the State of Georgia.
Two years after I graduated from college, my five-year divorced mother and I bought a triplex. She lived in one townhouse, I in another and we rented out the last one. When I was ready to buy my own home, I quit claimed the triplex to her and bought my own home. Fast forward 10 years. My mother is retired, she bought a smaller house in a better residential area, the triplex renters are gone, she got a loan modification, she is about $9,000 behind on the triplex and now she "needs to let the triplex go." After reading many forums about quit claim and checking my credit report, I know I am in deep financial trouble with her. Herein are a few of my many questions.
1. If she declares bankruptcy, will my house, income and credit rating be in jeopardy?
2. Will her personal house be taken from her?
3. What should she do since she can’t pay for the triplex and her home?
4. What should I do?
