    Default Reopening an Old Case Without Having UI Consider My Most Recent Job

    My question involves unemployment benefits for the state of: CA
    In April of 2009, I was receiving unemployment benefits from a seasonal job (taxes). I began working a part-time job that took me on the road, where conditions were horrible to say the least. The pay wasn't what was promised, no per diem as promised, etc. Suffice to say a lot of problems. In August I was home with a badly burned leg, and upon recovering, was never called back (I didn't want to go anyway!). I tried to re-open my old claim from my previous employer, but EDD has somehow latched onto my most recent employer. I have an appeal later this month; Should I tell them that this is regarding the old case, or would I do better just staying quiet and letting them go on with this most recent employer? I really, REALLY need the UE benefits, and any help would be appreciated.

    How would you propose to "open the old case" without their considering your new job, compensation and the ambiguous circumstances of your departure from employment?

    If you re-filed indicating that your previous employer was your most recent employer, you can expect your claim to be denied. EDD may also take other action against you.

    Copperhead, EDD always counts your last employer when it comes to filing Unemployment. If you quit your last job, you will be uneligible. But you said the employer didn't call you back, so does that mean you were terminated?
