    Default What is a Second Offense

    Texas
    If you get leniency the first time what is considered the second time.
    Say first offense is conviction of property shoplifting theft a class B misdemeanor and probation period has past. Is the second:
    theft a class C?
    theft a class A or B?
    any charge?
    ?

    What about many years later?

    I don't expect a nondisclosure order to help, but what you plead no contest the first time?

    What if no priors but 2 charges are pending at the same time? 2 of the same? 2 different ones?

    You need to 1) stop fretting and go to bed and 2) stop posting so many threads asking essentially the same questions. Keep it all in one thread.

    If you get leniency the first time what is considered the second time.
    It's the next time you get busted, no matter how many years later. The courts can see that the first time you got diversion or deferred adjudication.
