    Default Confidentiality of Unemployment Claim

    My question involves labor and employment law for the state of: CA

    I recently resigned from my job because a while ago my boss told me that he had feelings for me and wanted to marry me (even though he is already married with children and he knows that I am in the same situation). This made me feel incredibly uncomfortable and combined with frequent international travel with him, gave me very good reason to resign in my head.

    I worked in a relatively small industry where everyone knows each other and I hope to someday work in the same industry. My boss is an executive well known to others in the field. For this reason, I did not want to state anything about what went on.

    My questions are:
    a) based on this information, can I be eligible for unemployment?
    b) if I provide this information to the CA EDD, will it remain confidential or are they forced to corroborate this story with my ex-employer?

    a) Possibly.
    b) They WILL doublecheck your story with your employer.

    There are NO circumstances under which an employer will not be contacted re: unemployment and why the employee left. They're not going to just take your word for it.

    Based on this, and knowing that I don't want to suffer the repercussions of the accusation, should I just give up and not apply for unemployment?

    Or can I somehow phrase my reason for leaving as the requirement for me to travel too frequently? The expenses for hiring a nanny to cover me and going to the therapist to work through the stress almost outweigh my old salary.

    What kind of repercussions do you think you're going to suffer? You're not employed there any more.

    I wouldn't advise changing the facts around your resignation. Quitting because you were suffering sexual harassment might or might not garner you unemployment benefits, but quitting because of frequent travel in your job almost certainly will not.
