    Default Speeding and No Proof of Insurance Ticket in Texas

    My question involves a speeding ticket from the State of: Texas.

    Today I was pulled over for going 50 in a 40 zone. First I wasn't going 50 but I will leave that for a different day. My actual question is why did the officer give me a ticket for failing to show financial liability?

    On December 6th, someone t-boned my car. I was finally able to get a rental today. After picking up my rental, I was on my way home when the officer pulled me over. After checking all paperwork, he said that I will have to write you up for not having insurance because the insurance you showed me is for Lexus ES 330 whereas you are driving a Chevy Malibu. WHAT? I told him that my Lexus was totaled and showed him the rental agreement but he was adamant about handing me a ticket for showing no proof of insurance. He told me to contact my insurance company and get a proof that the car I was driving was covered. WTF? Is there such a law? I thought the insurance follows the driver and since I had an authorized rental agreement, I should be good to go. Any ideas?

    Texas law requires that you have proof of insurance in your vehicle. Often presenting a policy showing that your regular vehicle is insured, or a rental car contract, will satisfy an officer. I guess the officer is concerned that you may not have rental coverage on your insurance contract? (I can only speculate.) Did you obtain any insurance through the car rental company?

    No I declined the insurnce offerred by the rental car company but I showed him the police report of the accident along with the insurance that the car involved in the accident was covered. Then I showed him the rental agreement. He said that when he pluged in the license plate in hiscomputer, it shows no insurance and that I need to prove that this particular car is covered.

    It does not make sense to me at all.
