    Question How to Remove a Guardianship for Structured Settlement

    My question involves guardianship for the purposes of settlement in the State of: Kentucky.

    First let me say, we were advised by the insurance company to file this claim. We are married and my son lives at home and is attending college. The settlement in question will be used for his education and his future only. The settlement is for an accident in which I was the driver and my son was the passenger.

    My wife was appointed as guardian over my son, who was 17 at the time of the settlement, "for the purposes of settlement and release of his claims". My son is now 18 and my wife has been instructed by the court to submit paperwork removing her as guardian over the settlement.

    What do we need to do to accomplish this elusive task?

    It looks like she can use Kentucky court form AOC-795 (Petition for Relief, Modification or Termination of Guardianship) - go here and scroll down to 795, or see if she can obtain one from the court.
