I recently received a dismissal for a Class B Misdemeanor in Harris County, TX. I am wondering if this will appear on a background check, specifically one with the company Certiphi, who will be conducting my background check.
From the Certiphi website, I found that the background check will consist of records found through:
A search of county felony and misdemeanor records, directly through the courthouse
A statewide search of felony and misdemeanor records, directly through state repositories or court systems
And federal search, which I'm not concerned with.
I was arrested and my case went to the Harris County Criminal Courthouse. I am not sure whether the Harris County Courthouse makes all misdemeanor records public, even when it does not result in a conviction.
I see from the Texas DPS website that "the information contained in CCH is only public if a conviction or deferred adjudication has been reported to the Department on an offense" so I am assuming the statewide search will not turn up anything. I am just worried about the county search.
EDIT: Doing a quick search of this forum, I found another person who had a Class A Misdemeanor for possession in Harris County post saying that the dismissal of his charge was still on his background check. However, I noticed he went through deferred adjudication and know for a fact that deferred adjudication dismissals still show up on background checks. I did not go through any deferred adjudication, only a few community service hours, to get my dismissal.
