Default Removing father's name from birth certificate
RECENTLY , I JUST FIND OUT THE FATHER NAME ON THE BC IS NOT THE BIOLOGICAL FATHER, AND MY BABY IS 3 MONTHS NOW, I WANT TO REMOVE HIS NAME ON THE BC, I LIVE IN pembroke pines Florida, WHAT SHOULD I DO?

How did the presumed father's name get onto the birth certificate in the first place? How do you now know that he is not the father? Does he wish to remain on the child's birth certificate?

A: he signed the paper because he thought he was the father...and i thought he was the nfather too.... :!:

How do you now know that he is not the father?
A: because he showed me a DNA test that said he is not the father

Does he wish to remain on the child's birth certificate?
A: NO, he wants me to take him off the birth certificate as soon as possible

Are you 100% sure that he did a dna test on your child and not the neighbors mother or dog? Don't do anything until you do a legal test. You would probably have to do that anyway.

You may wish to initiate paternity proceedings against the biological father, and ask that the incorrect affidavit be set aside as part of the relief granted by the court.

I really dont want to know if he is the father or not , is it necessary to file a Motion for Scientific Paternity
Testing.?
since I already know that he is not the father because of the DNA test .

The person you would identify as the father in any paternity action (you know, the actual biological father) is entitled to scientific testing.

I am filling out the forms and I have to send them to him so he will answer the following form

what i need to know is that in my petition there is not an option to put that he is not the father . the only option there is to say that I think he is the father (which is not my case) .
so I think he will have to answer that he disagree with my petition and then I will have to go to a trial instead of a hearing ...
I do not want to go to a trial because then i will have to file a Motion for Scientific Paternity
Testing and also we both agree that he is not the father and we both want to take him off the birth certificate and change the baby's name , So I need to know what do I have to do ...is it necessary for us to go to trial?

there is not another person who can be the father .. I dont Know who it was...so there is not a biological father that i know of
