    Default Can an Employer Refuse to Pay Because of Lost Equipment

    My question involves employment and labor law for the state of: Minnesota

    I had an incident at work where someone stole a two-wheeled dolly from the premises. My boss told me upon hiring that if one was taken while I was on duty that I would be fired and I was.

    I'd offered to replace the dolly and my employer refused. Now they don't want to give me my last paycheck--probably to cover the costs of the new dolly, but they paid for more for the dolly than it should have cost, and I'm worried they might try and slam me with a bill for what my check didn't cover.

    Can my former employer do that when I offered to buy and new one and they refused? Can they refuse my last paycheck, at all?

    No they can not refuse to give you your paycheck. No, they can not make you pay for the dolly. These sorts of tactics have been illegal for many years.

    No, they cannot refuse to pay you for hours worked. File a claim for unpaid wages with the state Dept. of Labor. I don't think they can even deduct the cost of the equipment from that final check without your written authorization, but I can't give you the cite right now because the MN DOL site is down.


    Don't barter away your paycheck. If the site comes back up this weekend, I'll come back and provide the cites you need.
