Default Establishing Paternity- Non-Cohabitating Husband is Not the Father
My question involves paternity law for the State of: North Dakota

My question is, I am legally married, but we have been seperated since August of 09. I became pregnant in Oct of 2009 with my boyfriends baby. My husband took off and no one knows where he is. How can I establish paternity if I cant get him to sign a paper stating he is not the father. I have been livng with my boyfriend since before I conceived, My husband has been gone since August and also had a vasectomy. I would like to establish that he is not the father before the baby is born if possible, so that way when the baby is born next summer my boyfriend can sign the birth certificate then with no hassles. I will be divorced by then as well.

When the baby is born your boyfriend can take a paternity test that establishes that he is the father.
