    Default Can I Press Trespassing Charges

    Recently in Oklahoma I had property stolen from outside a house I own but do not live in (vacant). After filing out a report and trying to press charges about the thief and malicious mischief, the alleged perpetrator had someone trespass on my property to take pictures of the house. The alleged perpetrator then put these pictures on a website (giving full credit to the alleged trespasser) running the condition of the house down as a justification for the thief. I do have an attorney on the other matter with a court date in January but want an opinion if I can pursue trespassing charges base on pictures they took.

    can you prove he took the pictures, when the pictures were taken, and that they could not have been taken from a legal vantage point?

    Thank you for your reply. The pictures were posted on a website given credit to this person. They were dated and from the vantage point could only have been taken while on my property. Thanks again for your help on this matter.

    can you prove anything I asked about? What you posted is not proof an anything except possibly the vantage point.

    That is all the proof I have, the pictures are dated on the web site (after the property was taken) with "photo provided by this person" printed under the picture. The website has since been dropped but I have it downloaded. I don't know if this is proof enough to get a charge filed or not, and don't know if it's worth pursuing. I will talk with my attorney about this after we get into the next phase of this case. Thanks
