    Default Internet Affairs and Alienation of Affection

    My question involves alienation of affection law for the State of: North Carolina

    My husband started talking to a woman over the internet, which led to phone calls and emails, nude pictures being sent, etc. I have messages between them telling each other how much they love and miss each other and can't wait to be together. She lives in another state and they have not met in person but he has asked for a divorce and says he doesn't love me anymore. I have lots of emails and phone records. Before this he was constantly telling me how much he loved me and our marriage was good except for normal martial spats. Do I have a case to sue her?

    So according to the following:
    The North Carolina Courts, in Cooper v. Shealy, 140 N.C. App. 729, 537 S.E.2d 854 (2000), found that an out-of-state defendant's phone contacts with her married boyfriend were sufficient contact to justify permitting a lawsuit against her under NC law in a NC court.

    Do you think I have a case? This has totally destroyed me. I had no clue and can prove by the emails, she knew he was married, they had conversations about me.

    Whether or not I think you have a case is irrelevant.

    If you want to move forward, your next step would be to take your evidence to an attorney in your area to see if S/HE thinks you have a case. First consultation is often free.

    A word of caution: Alienation of affection proceedings are public, and the news media likes to jump all over them. Should you go forward, be prepared for a lot of unwanted attention, and the details of your marriage and its subsequent breakdown to be splashed all over your local newspaper.

    Thanks for the warning but I don't think anything could be worse than what I am feeling right now, and she deserves to pay for contributing to destroying my family.
