Assuming paternity was established by acknowledgement, file a petition to vacate the acknowledgement of paternity. Take note of the time constraints.
i have the marriage certificate, should i still use this "petition to vacate the acknowlegde of paternity" to remove his name, and also, do i need to hire a lawyer or i can just file by myself ? Is it DNA MUST BE TESTED even though we both agree to remove his name in BC ?
You didn't mention that you were/are married to the presumed father. You should be able to resolve paternity issues in your judgment of divorce; consult a divorce lawyer.
