    Angry Handicap Line Parking

My question involves a traffic citation from the state of: Florida. I received a parking ticket for $336 for parking my motorcycle in the "aisle" of a handicap parking area. However, the spot in which I parked was up against the curb (parallel) and the blue lines that I parked over were very faded while the other blue lines were nearly new paint. I feel as though I should not have been cited as I was parked out of the way with at least 5-6ft clearance. Advice?

    Pay the ticket.

The "aisle" you parked in is set aside so that a wheelchair van can unload in safety.

Why would you think that you could park in a lined out spot?

Regardless of faded paint (honestly - don't EVEN go there) was the space designated as handicapped as required by law?

I was far up and in between where no vehicle could put the lifts anyway....there was plenty of room for a whole car in between where my bike was and the actual spot anyway. The blue lines were merely nonexistent.

that is a lousy argument. It doesn't matter if you were where you believed it would not be used, the fact is, if you were within the area designated as a HC parking spot, you were breaking the law.

If you really want to argue it, look in the link minutes posted and see if the spot fit the requirements for marking a HC spot. If they markings/signage does not fit the requirements by law, they cannot enforce the ticket.

If the space was marked properly, as required by law, pay the ticket and quit thinking you get to make the decisions on if you were far enough out of the way or not. It is not a matter of degrees, it is a yes or no, black or white answer; you were either in a HC space or you were not.
I am not an attorney and any advice is not to be construed as legal advice. You might even want to ignore my advice. Actually, there are plenty of real attorneys that you might want to ignore as well.

Thumbs down Re: Handicap Line Parking

Shawna - there is a HUGE difference between the lines being "very faded" or their being "nonexistent". Pick one. I suggest you go with your original (true?) story and pay the fine as cyjeff recommended.
