    Default Statute of Limitations on Old Warrant's and Miranda Rights

    My question involves traffic court in the State of:California
    I have two questions.
    What is the statute of limitaions on a traffic warrant? I was recently arrested for a warrant out of the L.A. area but have not lived there since 1997. Is the statute of limitations up on this warrant?
    At the time of my arrest I WAS NEVER GIVEN MIRANDA rights?
    Can I have the case dismissed because of this? Or are the police not required to give you Miranda if being arrested on a traffic warrant?
    I have been given a new court date in the L.a. area, but I live in Sacramento, will I still have to go to this court date ?

    that's 3 questions, so far but anyway; so? Miranda rights only apply of they intend on using your answers against you in court.



    Can I have the case dismissed because of this?
    Not even close

    Or are the police not required to give you Miranda if being arrested on a traffic warrant?

    Do you HAVE to? Of course not but there would be another warrant issued for failure to appear should you decide not to go.

    You talk JUST LIKE A COP! I know my arrest was the biggest thing going that day apparently I am a HUGE criminal. A traffic ticket that is over 13 yrs old....
    I'm sure just like the cops that day, it allows you to be RUDE because now I AM less of a citizen.....but thanks for the answer...

    RUDE? Who was being rude? Or, perhaps you just think it is rude when someone doesn't give you the answers you want.

    to be a real question, even though it ended with a question mark, or it would have been SIX), and JK gave you reasonable and accurate answers. I see nothing RUDE about any of them -- terse, perhaps, but not rude. The only thing I might add is to suggest that you contact a lawyer in the LA area and have them go to court in your place. It will cost you some money, but it will probably be cheaper than flying down there yourself.

    I'm better at cowboys and Indians and I always play the cowboy. It's sort of like cops and robbers 'cuz in the end, somebody gets f'd (and that is always the robbers or the Indians). In cowboys and Indians, the cowboy comes across as a nice guy though. In cops and robbers, the cops are always referred to as Dr. Manhattans little friend.


    (for that reference, research "The Watchmen" and the big controversy concerning Dr. Manhattan)

    You got a ticket. You never took care of it. The state doesn't give prizes (like amnesty) if you are really good at avoiding taking care of it.

    Besides, I don't think you should have been driving at 2 years old anyway... because your response sounds like it comes from a petulant child.





    What about indians and robbers?
