I am a British citizen and passport holder. Back in 1997, I attended a training course in Texas which due to various reasons resulted in me overstaying by 1 day on the VWP. At the time I did not really think it would be too much of an issue as it was only 1 day.
On my most recent trip to the US back in 2004, at the immigration counter, I was taken to a side room and asked a few questions by an officer about the previous trip and he was satisfied with my responses and granted me entry.
I had my vacation and then departed after 10 days.
I have not been back to the US since thaqt vacation trip in 2004 but have always wanted to visit New York and would like to make this trip withing the next 3 months or so. Should I apply for a visa - I live a long way from the US embassy in London - or given the fact that I have completed a "compliant" trip to the US since the overstay trip, do you think that that I should try to enter on the VWP?
