    Default Officer Did Not Mark or Write Any Violation on My Ticket

    My question involves traffic court in the State of: Illinois - City of Chicago.

    I recently got a ticket, I was told for failure to stop at a stop sign, a municipal violation in Chicago and the officer did not mark anything in the violations area. There is a checkbox for failure to stop and the entire section is blank, and nothing is written in the "other offense" section.

    I wanted to admit guilt and just pay the fine, but it says I must appear in court.

    My question is, since the ticket is not marked for any violation, what are the chances of the ticket being dismissed?

    If the officers notices the mistake and marks the ticket after giving me my copies, my unmarked copies help my case for dismissal?

    I think i found the answer to my own question, this is directly from the Cook County Courthouse webpage.



    1. Right to know the charge
    Every person receiving a traffic ticket is entitled to receive a copy of the charge in writing.

    The ticket must contain the following information:

    * name of the accused;
    * nature of the charge;
    * statute or ordinance alleged to be violated; and

    * date, time and location of the alleged violation.

    Other information on the ticket is statistical in nature and not required to properly charge a violation.

    When there is a defect in a ticket, in most instances any objection to this defect must be made before a trial occurs.

    There is always a chance that if the officer notices an error on the citation, that he/she will serve an amended citation upon you after the fact but before your scheduled appearance date in court.
    I am right 97% of the time... Who cares about the other 4%!
