Lightbulb Can You Go To Jail Over a Fake CV or Resume

If a person has a webdesign agency.
He builds fake resumes with fake names to attract clients.
Then he assign projects to web designers from his agency.
Then he sends the projects back to the client from that faked name without mentioning the name of the agency.

Is this action illegal and would it makes him go to jail or something?

It certainly isn't ethical, but it would be up to the clients to sue him if the work wasn't done according to their expectations.

Well, all clients are satisfied and they are NOT from USA anyway .. Plus, all money transactions are made through a foreign not-American bank ..

But would you please explain how is it illegal to make up fake names and CVs to earn money? And if no client sues the owner of that agency, would the government investigate?

I am sorry for these questions, that might seem silly to you, but it is not to the one who needs the answer of them

    Thanks!

In this country, it is only illegal to assume a name if you do it for illegal purposes.

Many actors, for instance, use a stage name.

Unless the work is not being done... unless there is some fraud committed and one of the people defrauded calls the police, the police won't care.

But it is not just fake names ... But fake CVs too! Doesn't this considered dishonesty and criminal?

If the resumes were of real people or the persons contracting for the service weren't satisfied, there may be something to work from.

If you advertise yourself as having certain legal or professional qualifications and you don't, you "may" be held to answer for a misrepresenation/fraud suit at a later time, is it worth it?

But that case would had to be brought by the injured party... and it would be a civil, not a criminal, matter.

The CVs state that the "name" has degrees in something and certifications in something, but it is all not true because the CV's holder doesn't exist

Plus, the CVs have unreal addresses .. So how can someone sue an unreal person who lives in an unreal place ?!

What is the difference between civil and criminal matters?

Can you go to jail because of a civil matter?

It would probably be a Tort, if anything, remedial through the Civil process.

Criminal expressly means just that, the state has passed a law meaning the conduct is forbidden, and is a CRIME, and punishable by a fine or imprisonment or both.

DEcriminalization means although still against the law, the state has done away with jail time for an offense that was once classified as a crime, such as a minor MJ possession charge.

IF such professional conduct requires that a license be on hand, and is not, it could be criminal. If one holds themselves out to be a real estate agent when they are not, etc., etc. If this codified as criminal, then it is, such may be a civil admistrative matter by the state, it depends.

Can you be sent to jail in a civil matter, sure there are times, such as Indirect contempt of court. Fraud concerning assests you hide in an insolvency proceeding/civil lawsuit judgment.
