    Default Out of State Window Tint Citation

    I was pulled over while driving through Arizona, in a car registered in New Mexico. The tint is below the legal limit of both states, however NM has a 20% tint law while AZ is 35%. While I initially do not have a problem fixing the tint to my state's legal limit, the citation includes a statement that the problem was fixed in accordance with AZ state law. How are they allowed to enforce this law to AZ standards when it is legal in my state? Additionally, am I just never allowed to drive outside of my state or do I have to take off my tint when I want to leave NM?

    Furthermore I will be calling in the morning to clarify with AZ state patrol, but there are really no instructions as to who to bring the form to, to sign. It simply has a place for the "Firm" to put their address and signature after they've verified it. There is also no option to forfeit a fine in lieu of fixing it, I've heard you can do otherwise... any help there?

    If the problem was fixed, then the problem is fixed. So what's the problem? If the problem isn't fixed, why did you say the problem is fixed?

    You should be able to defend, assuming you're not legally required to have this car registered in Arizona, by proving that your tint is legal in the state in which it's registered. But you appear to be telling us that you can't do that.

    Wow you really need to be able to read more accurately. I said that I have no problem fixing it to NM standards, however that law differs from AZ law, which the citation states it needs to be fixed in accordance with.

    Furthermore, the citation was apparently in line with a warning, which is not tracked and the officer I spoke to said to pretty much disregard it.

    Actually, the problem is that you don't write well.

    Why not use your brain? They have to remove the unlawful tint to put on a legal tint. So have the illegal tint removed, get the repair certified for the court, and then put on a tint that's legal for the state in which the car is registered.

    I really don't see the problem with the way I wrote the question. I've read it a few times to see how you were able to extract the tongue twisting question you presented in your first reply.

    Yes I understand that I could jockey around having tint removed, signed off, then reapplied. While that doesn't really address the principle of the question I was asking, my solution is to now make a notation of the officer's name and badge number on the repair order and file it away in case anything arises later from it. Otherwise, it will be disregarded as per his advice.

    Well as I was told on the phone by an officer from the same district as the issuing officer, this is a Warning/Repair order and not an actual citation. He told me they are not tracked in the system in any way and the only negative repercussion would be that if I lived in AZ and in a few weeks he was to pull me over again and the item was not fixed. At that point he would issue an actual citation. Seeing that I was just passing through on my way to CA, and that I can't foresee the next time I'll be near Yuma I'm not that worried. He told me verbatim, "You can frame it, or throw it in the trash". Also that he personally doesn't cite/warn/whatever out of state vehicles for tint for this reason.

    I can give you his phone number and name/badge number if you'd like to talk to him.
