    Default Visitation pick up

    My custody order does not specify where my child's father is to pick up or drop her off at. In the past I have met him at a store near my home. I have had car trouble for the past few weeks and he has brought her home after his Wed. visitation. My child has SAT's this week and I want him to bring her home so that she can get to bed as soon as possible. He says he will only meet me at the store. Isn't it his responsibility to bring her home? The order states that he is to have her on Wed until church is over and no later than 9:00. He always only brings her home at 9:00 regardless of whether they go to church or when it ends. Are there any measures I can take to prevent him from continuing to do so?

    If the order is silent on something, such as the point of drop-off and pick-up, but there is clear past practice, a court will typically expect that you will follow the past practice. How great are the distances involved? For example, is your ex- obnoxiously refusing to drive six extra blocks, or is he reluctant to add twenty, thirty or more minutes of drive time to his end of the exchanage?
