    Default Case Continuance

    I live in Mississippi.

    How long can a case stay in continuance? My simple assault case has been in continuance for over 2 years now. It has gone to court twice and both times the lawyers ask for continuance. The plaintiff's lawyer is trying to keep it in continuance because the lawyer does not want it to go to trial since he knows that he will lose the case; the plaintiff is not wanting to drop the charges. Is there a certain amount of time that a court case will stay in continuance before it is thrown out or that a decision MUST be made on whether I am guilty or not guilty.

    If your lawyer is asking for continuances, the continuances don't prejudice the prosecutor's ability to pursue the case. If you want your lawyer to stop asking for continuances, instruct him to stop.
