Default 17 Year Old Georgia Teen School Suspension

My question involves a driver's license issued by the State of: Georgia

The scenario 17 year old teen suspended from school for allegedly admitting to administrators he smoke marijuana at lunch. They did not find any drugs on him. He was not arrested or charged then or now. Can he be charged later?

He will loose his license for a year.

He plans to drop out and get his GED but cannot register until January 2010 he is looking into other options in other nearby counties
He is already working on the opposite side of town from where he lives and also on the opposite side of town where his parents work

He is going to counseling and group sessions

HE IS ONLY ALLOWED TO DRIVE TO AND FROM WORK AND TO GROUP SESSIONS-HOME RULES

What is the likelihood of him getting a Georgia Hardship License ?

Will getting an attorney matter as from what i read the parents/minor just file papers and they either approve or deny

    Wait, hang on.

If the police were not involved, if he has not even been CHARGED with possession, let alone convicted, how is it that he's going to lose his driver's license?

    Controlled Substance Or Marijuana

A person charged with possession, distribution, sale, use, etc., of a controlled substance, will be treated as follows. You do not have to be in a motor vehicle when these violations occur, for your license to be affected.

    * For first conviction, license will be suspended for 180 days from conviction date, license surrender date, or process date. May reinstate with DDS-approved Drug Use Risk Reduction Program certificate and payment of a $210 fee if processed in person or $200 if processed by mail.

Has he received a notice of suspension from the DMV?

Georgia's fairly new law states any student r 18 ears old that misses 10 or more days - unexcused which includes suspensions will loose their license for unde1 year or until their 18th birthday. They claim a drivers license is not a right but a privilege

    No notice yet....

They are correct in that. No one has an inherent right to drive, and if the state doesn't think you should have a license, they don't have to grant you one.

Whether he will be eligible for a hardship license under this law is going to be up to the discretion of the state. Contact the Department of Driver Services by telephone at (678) 413-8400, (678) 413-8500 or (678) 413-8600.
