Default Non-Payment of Spousal Support
My question involves divorce in the State of: Pennsylvania

My ex signed our divorce agreement/equitable distribution agreement back in 2001 which I was awarded child support and alimony along with payment for our business for the next 15 years. The total is 3500/child support, 3500/alimony, 1400/business. In March, 2009, he decided to stop paying alimony and business. The alimony is until death of either party and if I remarry or cohabitate it is reduced by $1000. which I have not done. My attorney will not represent me due to owing too much money because of child custody issues that my ex fought me on. I believe he is trying to bankrupt me, gain custody of the kids in order to not have to pay me anything. I work part-time but do not make enough to support me and my 4 children. Will the courts enforce the spousal support and business payment to me? I filed a petition on my own behalf and am currently awaiting a court date.

Yes, the court can and most likely will enforce the order.

The only thing that might cause a problem will be if your ex has had an involuntary loss of income.

He is claiming now that he is a million dollars in debt, however, he has been living a lavish lifestyle. He has admitted to earning over $200k plus last year and has his own business. He has always been 'creative' in his financing and claiming of 'business' expenses. Will I have to prove it or will he?
