My question involves paternity law for the State of: Virginia
What steps do I need to take to add my name (father) to my daughter's Virginia birth certificate. Her mother is deceased and we lived as domestic partners prior to her death.
There's presently no father named on the birth certificate? If somebody is named, who is it, what's their relationship to the mother, how did they get named, and what's their position on your being named? The child is now how old? The child is in your custody?
There is no father's name on the birth certificate.
My daughter's birth certificate has her mother's maiden name on it which is also her last name.
She's 18 yrs old and under my custody and is currently in college.
Her mother passed away two years ago.
It appears from the Virginia statutes that you or the (adult) child may still initiate a paternity action. Check your county court's website for information and forms (see, e.g., York County).
Thank you for your advice.
