Police Record Not Arrest Record

My brother was investigated by the local police, they took his picture and pictures of his myspace. After he spoke with detectives no charges were filed. My question is I know he does not have an arrest record. However he does have a record with the local police. Who has access to this file and how can we get them to throw it away. I mean he was never convicted I dont see why he should have a file.

Sorry im a bit ignorant about this type of legal stuff.

As an investigative file, they are not likely to "throw it away" absent a court order. Your brother can call the agency and ASK them to purge it, but I think it safe to say they will not.

As for who has access to the record, probably no one. If he ever goes to work someplace where he signs a waiver allowing the employer to look into such records, then it may pop up if the employer bothers to contact the police department in question with the waiver, but other than that is not too likely to rear its ugly head.
