    Default Served Again Even Though Case Case Was Decided

    Okay my ex-husband and I had a consent judgement of chaning domincilary parentage, making me the non-custodial parent. In the process, we decided that no child support would be paid, but we would share non-reimbursed medical. He recently, after a year, took me back to court on the issue of child support. I'm in school right now, but the judge, apon agreement between ex and I in court, ordered me to pay 100.00 until I got out of school. Also the payments are deferred.

    His lawyer was supposed to type the on the records agreements. She did, and I signed it. Now he refuses to sign them "in new evidence that I have a new car." The car by the way, was a gift for making the Dean's list the past two semesters, and this term taking 21 credits with A's at midterm. Anyway, while in court, I told the judge that this really wasn't about child support; he is just trying to make me 'hurt'. And, that we'd be back here; he makes over 75,000.00 a year. I make nothing. So the judge told me and his lawyer to put it in there that he cannot and will not attempt to file charges or make changes in this agreement unless I quit school and become gainfully employed or finish.

    Well how come I can be served AGAIN?

    Presumably because your ex- filed a petition and served it upon you. If that was in violation of what the court previously ordered, ask the court to dismiss the petition and award any appropriate sanctions.

    Even though the paper wasn't signed; the judge ordering it in court was enough?

    If no order was entered, then presumably the current hearing is about getting an order entered. You were the one served with the paperwork - it should tell you what the court hearing is about.

    If you don't understand what happened in court, or don't understand the documents that were served upon you, you should consult a lawyer so you can figure out what is going on.

    Well, I was served the first time. We went to court; the judge proposed that I pay 100.00 per month, but the payments would be deferred until after school.

    We both agreed. Since I did not have a lawyer, my ex's lawyer said that she would write a paper of what the judge said and that we would both sign it. The judge said okay and that he would sign it.
    And, the judge said that there also needs to be something in there that he could not take me back to court on this until I finished school.

    But because they refiled, and my ex did not sign it did the judge order it? And would that hold up?
