    Default What Are the Man's Rights to a Paternity Test

    This year, my step-son moved to MA from NM where he had had a sexual relationship with a woman at the same time as another man. When she gave birth this past week, my step-son had thought that she would have a paternity test done of the other man, but she did not and the other man didn't want one either.

    However, my step-son thinks that the baby could be either of theirs and desperately wants to know if he's the father or not.

    Could anyone tell me and/or direct me to a site that could tell me what his rights are? Specifically, if the woman is not willing to do so, does he have any legal rights to a paternity test and if so, can it be done without him having to travel to NM for it?

    Any help would be greatly appreciated.

    yes, if he believes there is a possibility it is his child, he has every right to demand a paternity test.

    as to travelling to NM; you would have to contact the courts in NM to ask them. In some states, such situations are dealt with with no actual court hearings, just filings, until paternity has been established.

    Is NM acts similarly, he may not have to go IF they will accept a DNA test done in his current state.
