    Default Old Support Arrearage

    My aunt, who is 58, thinks that her father owes back support from when she was a child, and she is wondering if she can get it.

    Default Child Support, Standing, & Statute of Limitations

    It is likely that any right to collect has expired under the governing statute of limitations. As not all states apply a statute of limitations to child support, this depends upon the laws of the state where the support arrearage accrued.

    Additionally, depending upon state law, you may run into the issue of whether your aunt has the legal right to seek to enforce an arrearage, which would have been payable by court order to her mother as opposed to being payable to her.

    Your aunt should discuss this with a lawyer in the state where the arrearage accrued.
