    Default Immigration Check Upon Entry

    Hi.. I just want to know any experience from others, that overstayed in the US, and tried to reenter, lawfully.

    I overstayed my J1 for 2 years, and right before leave, I realized all the penalties in my case, like the 10 year bar. Im Universiy Graduated in my homecountry, and I wanted to do a MBA here, but because my situation, Im going back home. The only thing that bothers me, is that I wonder if one day, if im working for a company, they decide to send me to the US for a trainning or something, wich happends frequently, whats gonna happend?

    Did anybody went through this situation? Experts, do you know something about it?

    Reading the the post about the guy on F1 visa, im thinking about fly to us and see what happends.. just to see and leave the agony!

    Also, do they really know everything upon entry? What kind of informations do they check?
    Credit cards, internet, social security, driving record... all that? i've heard about people staying illegal and re-enter.. but that was b4 fingerprints...

    First of all i'd recomend you tell'em true about your job etc..
    2nd I've visited canada and came from there so they've had no way to deport me but simply turn back to canadian side
    They would like to check everything about yo but they can't. so you'll be questioned.. and don't lie! good luck

    Ok, so you didnt fly to the us, u went throught the border driving... is that right? Man, I gotta tell you.. you were lucky..! this guy was very nice to you he could have gave you a 10 year easily. did you tell him you worked during this time?

    Yeah, obviously i had to work, and tell them where and when,, they 'd find out anyways.. the thing is i left US before my visa and I94 expired, but was out of status for over 3 years.. i know i'll have a very hard time to get a visa, but it's not damn 10 years..

    If your I-94 had not expired, you were out of status but not illegally present. It is illegal presence that triggers the ban. Out of status limits actions that can be taken and will likely make getting another visa more difficult and has issues if applying for a GC but has not triggered the ban.

    Yeah well makes sense... My i-94 says DS, doesnt have a date, but its the date on my DS-2019. Of course this one is expired. So i think there is no chance for me. Anyway.. I think its worth the try... I'll try to get a Business visa, if they deny it, whatever.. if not I'll come. If they deny entry. then I'll ****ing wait 10 years. my bad!!! Should have google it b4 do it. swear to god if I knew I would never overstay 1 year... I hope I dont get fired for that, its hard to find a way to explain company... thank you guys!!

    By the way, have any of you guys heard about someone that got inside again?

    yeah, there were that swedish guy.. he overstayed first time, they let him in 2nd time, but 3rd time he was denied bc of overstay on 1st time.. lol weird
