    Default Assaulting Teachers

    My question involves education law in the State of: Mississippi.

    I understand that teachers have become a "protected species" and hitting a teacher "in the course of his duties as set forth by employer" is a Class D felony. My question is, if a teacher is harrassing you about personal matters outside of school and using his teacher status to keep you from hitting him, is he protected?

    Former student, but the harrassment is purely personal conflict off of school grounds.

    If the teacher's conduct falls outside of the statute, by its terms the statute doesn't apply. What would happen in any specific case, of course, depends upon the facts of the case.

    Ummm - you do know that by law you can't just HIT people that make you mad - right? Regardless of what your former teacher says to you... Premeditating to beat someone up IS going to have legal ramifications regardless of your victim's profession.

    Teacher or no, assault is illegal.

    At what point did you come to believe that hitting ANYONE was OK?

    Im perfectly fine with assult charges, I can beat them because he has shoved me and used the teacher status to threaten me, but if it were felony that is hard to get around. So next time he lays his hands on me outside of school it won't be classed as a felony if i fight back is what im getting at.

    Any such "protected status" by law would NOT abrogate, by any means, on or off school grounds, a valid self defense claim; emphasis on valid.

    Assaulting a child, that is, under 18, may contain enhanced penalties under the law also, but again, defending onself is a right.

    This "minor" may be 6'10" and weigh 400 pounds, so if you are assaulted and can not retreat, if there is such a duty, does this mean you can't defend yourself?? No, it does not.

    Thank you all, I believe in the self defense claim, and I shall probably tell him this to hopefully keep him away from me. I doubt he will ever be hit because hes a 5'2" homosexual, and lets face it. This is Mississippi: Its common rule that you dont hit women, children, or retards, and im pretty sure he falls under all of these. But maybe he'll figure out im serious about him not being protected by that little law. Thanks again for your opionions.
