    Default I Was Punched First But am Now Facing Aggravated Assault Charges Causing Bodily Harm

    My question involves criminal law for the state of: canada
    Hi..in may of this year i got into a verbal argument which turned into a fight. She pressed charges against me for aggravated assault causing bodily harm. Im confused because she is the one who punched me first. Im pretty sure that i will be charged with aggravated assault and i can't claim self-defense for the reason that i used excessive force..but can she walk away with nothing if she was the first to attack? because if she wouldn't have touched me none of this would be happening.

    you can both be charged and both serve. her being arrested will, most likely, not help your case.

    It still isn't self defense. Not even a little. This isn't a playground where all you have to prove is that the other person hit you first. If you had any other option than hitting her back.... like walking away... it wasn't self defense.

    You are right, i should have walked away but ive been to anger management and im still learning to deal with it. She knew i was following classes and to me it feels as if she wanted this to happen. Its like an alcoholic..give them just 1 drink and they will want more. At this time i wish now more than ever that i could have walked away..now i face the consequences and i don't want to be alone...and just 1 more question..how is her being arrested not good for me?? I don't want her walking around thinking she can get away with hitting..cause im certainly not
