Help For My First Speeding Ticket

This is in California if that makes a difference. I have a perfectly clean driving record also.

Pulled over for 90 in a 65. Cop put down "speed in excess of 65" and cited the vehicle code. At the top of the ticket for observed speed it says 90 and 65 for speed limit.

Did he give me a break and just get me for going over 65?

Also, what do I do? Can I just pay a fine and do traffic school?

Here is the charge:

22349. (a) Except as provided in Section 22356, no person may drive
a vehicle upon a highway at a speed greater than 65 miles per hour.

The fine should be in the ballpark of $321.

Had he put you down for 91 or higher, the fine would be about $435.

You can challenge the citation and go to trial, you can plead guilty and go to traffic school, you can do a combination of the two (go to trial and ask for traffic school if you lose, for instance ...). You can also start with a trial by written declaration and ask for a new trial if you lose.

Others may offer up some more specifics on any possible defense.

That is not an easy ticket to beat. If you wanted to try, you could do a TBWD and after you loose that, a trial de novo. You could try to beat him on his paperwork not being in order, but other than that, you could count on losing.

Not trying to beat it. Just wanna pay the fine and do traffic school and hope it doesn't go on my record.

Just wanted to update. Did traffic scool and got out under $400
