    Default Summons in Civil Action "Request Answer"

    My question involves collection proceedings in the State of: Ohio
    I believe that I have to answer this summons by the Plaintiff XXXX and they are using as the argument that I applied for the card, Use of card bound me to the terms, and plaintiff is exercising the right to accelerate payment of entire balance. it's 5,735 allegedly owed. This is and will be a disputed debt in my response. Don't they have to have the original copy of the application of the Discover card account to prove that a contract existed? Any help would be appreciated. Thanks.

    You used the card, right? As they indicate in their complaint, that's ordinarily sufficient. If you in fact submitted a written application, as opposed to applying by phone, you can try to obtain a copy of the application through the discovery process consistent with the rules of procedure for the court in which the case was filed.

    Just be sure you answer the summons in the time limit allowed or they will get a default judgment against you.
