File quitclaim and pay 7 years taxes - who owns the property

It's my understanding if someone files a quit claim deed on unclaimed property for 7 years, that they will own it. The person who gave the quit claim deed was his son. Which has no binding to the land what so ever. It's a dirt road that the state neglected years ago. He's only got a few months to go before the 7 years are up. I'm desperate for answers. I hate to say it, but in this county it's all about who you know. My job of 17 yrs. was just shut down last week. We just recently found this out. Naturaly we're trying to save the expense of an attorney. Or at least find out what we're up against. I've been all over the internet trying to do all the research i can. But this is one question i can't seem to find an answer too. Please........any info would be greatly appreciated. By the way, i live in N.C. thanks.........if anyone could give me a website link where i can find answers..........Anything......DESPERATE FOR ANSWERS :roll:

A quitclaim deed from whom to whom? A quitclaim deed can convey only the interest of the grantor, so if the person who issued the quitclaim deed had no interest in the land conveyed the deed itself is legally meaningless.

That's what i would think. The only thing i don't understand, is how he has been able to pay taxes on it for the last 6 years. And i'm sure he has a reason for doing it. Thanks for your response......Have a nice day.....dhorton43

He may be trying to set up an eventual claim of adverse possession.

I really appreciate that info. Is there anything we can do to stop it? If we file a quit calim deed( from me to my husband) will that keep him from having ownership of the rd. We're going to the courthouse tomorrow, maybe we'll find out more. Thanks so much for your help. How about if we do work to the rd? It needs it badly. Do you have any kind of forms we could file at the courthouse? We'll try just about anything at this point. Thanks, have a good evening.

How about finding out who owns the land at issue (conduct a title search) and acquiring it from the actual owner?

That's the problem. No one knows who it orginaly belong too. It's listed in the mapping dept. as a street. One neighbor told me, it's been there at least 50 yrs. He thought it was state owned. My husbands boss is head of DOT here in the county. He said it wasn't. No one knows who this road belongs too! So actualy I would think it belongs to the county.? Thanks........Have a nice day

The land didn't come from nowhere. At some point, somebody owned it - be it the developer who built the neighborhood, a unit of government... somebody.

Who issued the quitclaim deed to your neighbor?

we went today to the courthouse. That neighbors daughter works in the mapping dept.( we thought she wasn't there today) She refused to file our quickclaim deed. Of course, because of personal intrest. I told you ......it's all who you know........or the amount of money you have in this county. We're going back to her supervisor Mon.(she wasn't in today) Don't want to get this girl in trouble.........but don't we have the same rights as him? Anyway, when we left(pretty upset) we did contact a lawyer. Thankfully, he does not know our neighbor by name. He's also the lawyer for the county. We have an appointment with him next week. I have to admit , i'm a little woried what this will cost........like i said , my job just shut down last week. All we want is to not drive over the grass i worked 15 years to grow, our daughters school bus to be able to come through it to pick her up and bring her home. Is that to much to ask. Even the bus driver said it would be a lot of help for her to be able to come down that rd........Thankfully, since i've been out of work, i can now take my daughter to school and pick her up. So i guess being out of work has it's ups and downs. But i'm fixing to go to college so maybe things will get better.........Has too!!!!!!!!Right? Thanks so very much!!!!!!!!!!!!and wish us luck!!

His son........who lives on the other side of town. He has no itrest in the land at all..........We know it's not worth the paper it's written on. But if he's paying taxes.........it want be long before it is his. He has family working at the courthouse........in this county that's how things work. You'll never know how much we appreciate your communication.
