Being Accused of Credit Card Fraud, Lost
My question involves collection proceedings in the State of: CA
I recently moved back near my mother in order to help her regain some health back and to move closer to the school i will be attending. In this process part of the deal was that we were gonna sell some jewelry and she was going to help me with a car. *which is nothing new she has been helping me monthly for the last three years. On top of other purchases like computer for school and help with my move.
She said that any money I might need during the move and other expenses i could use the card and we could take it out of the jewelry money. * i have letters of her writing about how excited she was to sell some of her jewelry and to get me some money.)
So we were in the process of having things appraised and also shopping the best deals around. a few weeks later she has a complete mental breakdown and goes missing for three weeks. during this time i was flat broke and took her for her words about her using the cards. Mostly i spent money eating out as I couldn't sleep, or even make a meal because i was so worried. the police finally found her living by the beach. She was hospitalized on and off for the last two months. and suddenly she has develped a keen hatred for me. she says she no longer wants to sell her rings and i told her thats fine, but i did use your card per what you said.
she says that she changed her mind and will press charges!
i dont know what to do? her credit card company is calling me everyday I have not called them back. I have tried to work out something with her and explain how god awfull the situation was but she is still in a manic schizo mode.
Do i talk to the credit card company? is that admitting everything?
If i even give her any money will that admit anything?
I do have letters talking about everything with the ring, hand written, but only have a typed letter talking about the credit card and expenses.
I cant risk a mark on my record as it will effect my whole income and life.
IM SO LOST???? and dont know what to do????
my whole life whenever she gets sick she has it out against me, i guess its been so long that I forgot what she was capable of.
total charges around 4000k.
any do's don'ts? advice greatly appreciated as I cant afford a lawyer .
One other thing that during this time she managed to come home for a day,
walk in her bare feet and buy a brand NEW CAR for 30k. than she was hospitalized again. and the family stepped in and returned the car.
I think this shows hos unstable she was.

You ran up $4,000 in charges over three weeks? That's some rather profligate spending, don't you think? Will your purchases back up the notion that you were doing this out of absolute necessity, not just going on a shopping spree?

it was actually over 8 weeks.
90% of it was spent on food.
I ended up going out to eat a bunch, because I could not stand to be at the house. I was up until 5 in the am the whole first month posting missing persons flyers and looking for her all around the city ( EVERY DAY AND NIGHT)).
I made 3 purchases that I made a poor choice on that I asked her about and she said (HAPPY BIRTHDAY)!!! but then
weeks later changed her mind! it was music related stuff that she wanted to get me for my B DAY! I asked her when she was in the hospital and agreed.
some money was also spent of flyers.
There was mostly groceries and out to eat as I COULDN"T cook i was so disturbed by the situation.

Do yourself a favor don't give anyone else these excuses. They don't work and they make you seem pathetic.

She was in and out of the hospital, which coincided with a b day.
She also managed to walk in barefoot and buy a 30K car?
but no one is mentioning that.
No one is really reading between the lines and is only stuck on minutia.

it wasn't three straight weeks in the mental hospital
it was three different 3 day holds.
she left the cards in my mailbox in an envelope that said 4 expenses.
I didn't see that in there till she was missing.
all the time I thought that we would take up the difference out of money promised to me.
from the sale of the rings.

None of us are mind readers and we can not comment on things you have neglected to tell us. I asked if she gave you permission while she was in the hospital because you did not provide that information. It is certainly relevant to your situation. Now you inform us that in a three week period she was admitted to a psychiatric facility three times. This leads me to conclude that you should have realized that your mom was unstable and in no way was her word reliable. You need to pay that credit card bill or face legal consequences.

she GAVE me permission before she went to the hospital.
and had me run errands for her when she was in the hospital. IE, use the credit card to pick me up a carton of ciggs, shampoo, some clothes etc.
and when she was out of the hosptial and mad at me for having her hosptialized she threatened me with I":LL get YOU BACK>

UPDATE, for all those who might be helpfull.
I had a doctor call *her dr to explain the truth. , the CC companies Stopped calling me.
but the charges are all being reversed and withdrawn.
It caused some issues with bills she paid etc etc but i worry
about any items I might have that get reversed? should I get in contact with those companies to return anything? or leave it be????
.

What, exactly, would you return? I thought you bought food?
I have a feeling that if you contacted the cc company with a willingness to pay that they might actually respond with a bill. At this point, if the charges have been "reversed and withdrawn" then there would be nothing to pay. I would consider the matter closed and not use the card again, even with your mother's persmission.
Veiw this as a lesson in gerontology.
