My question involves marriage law for the State of:
To answer the title question: You'd be married to an illegal immigrant, who is subject to deportation.
S/he cannot adjust status, as s/he entered illegally.

Is this question about somebody who entered illegally, or who entered legally then overstayed a visa? If it's the latter, what type of visa?
If he entered illegally, he needs to go home. Wait 5 years, then apply for a K-1 Visa. You can still visit him in his native country.
