Angry Web Host Agrees to Provide Pre-Paid Service; Months Later Service Still Not Complete

Several months ago I sent a message to my web hosting provider asking them to perform a very simple service on my server. They replied and told me it would be done for the standard $75 fee. I confirmed this fee ...but the task was never done ...or even started.

I contacted the main supervisor, who assured me the task would indeed be done. After that, the task was only partially completed. Also, as a result of the service, a very important program on my server stopped working.

I have contacted and spoke with the main supervisor many times. Each time I have spoken with him, he tells me everything will be fixed and the initial service will be fully completed immediately. However, nothing ever happens.

It has now been over a week since I have been able to contact him. I have left several messages, which remain not responded to.

It has been LITERALLY MONTHS now since I paid the $75 fee, and I am currently in the dead middle of a 6-month $300 contract, which I only signed up for to be able to take advantage of the service that was never completed. So basically, I have paid them $375 for virtually nothing.

Am I eligible to take any legal action at this point? What should I do?

You didn't answer the question about where this is occurring. If your both in the same state, you can consider small claims court. If not, you can still consider small claims court, but things get a lot more complicated. You will need to read your contract to see if you are obligated to arbitrate this type of dispute.

It's not the same state; I decided to just file a dispute with my credit card company.
