    Default Petition for Small Estate Less Than $100,000

    I'm in the process of filing a “Petition to Determine Succession to Real Property” in order to have a home transferred into my name. The decedent (mother) has been deceased over two decades. I’ve just received the List of Inventory from the Probate Referee showing that the property is less that $100,000. I’m need to determine if my siblings are considered heirs and should be listed on the petition. There is a Will that states that ALL the property goes to me unless I did not survive the decedent. In which case, the property would be divided between my siblings. I have one surviving sister and brother. The brother I haven’t seen nor heard from in twenty (20) years so I’m not sure where he is or how to find him if necessary. Since I did survive the decedent, am I the only heir?

    Laws are different in each state. Also, I'm not about to interpret a will I haven't read.
