Evicted Over Unfair Accusations of Illegal Activity

My question involves an eviction in the state of: Texas

I was evicted on 9/11/09 at 8am and was given a 24 hr. eviction notice and they told me if i was not out by then they would move my stuff out to the street. The reason my apartment manager gave me was that My mechanic, was over the night before and almost ran over the peace officer at the complex. It was around 8:30pm when it happened. I had spoken with my mechanic that night before the incident and was to bring my vehicle to his house because he has been my mechanic for some time and had done work before in his garage at his house. I was suppose to wait for him to call me to go to his house and i never received a call so i left to my mother in laws house which I was there for 3-4 hours the entire time of the apartment incident, after the incident he told me that this person rode up to him pretty fast on a bicycle and hit his car with a flashlight.. and he thought he was going to be robbed and just took off almost hitting the person



I sat down with the peace officer and the manager and they told me that my mechanic was dealing drugs at my complex. There evidence is a vehicle with 3 guys with criminal records for grand theft auto and possesion of ilicit drugs. they said that they were there because they bought marijuanna from my mechanic. My mechanc is well known for his work on cars and has a very distinct vehicle and could be recognized by anyone who ever met him. the peace officer stated that he had his badge on and his flash light shinning at my mechanics car, which it was 8:30 and it ws dark outside so the blinding light ccould have distorted my mechanics view and didnt realize it was a cop not a person attempted to rob him!

The apartment manager and officer had stated that there had been breakins and thefts recently and they were incinuating that i was involved with this!
They said the the 3 guys in the other vehicle said that i warned them that there was new bycicle officers on the property that they sent everyone in the complex letters stating new security which i never received this notice nor did I know there were new officers! I have no idea who the 3 other ppl are and I was given there names and I have never ever met these people so the peace officer is lying and trying to put the break ins on me! I have no criminal record nor have i ever been in trouble for anything major only in school for very minor things. I am going to school to be an engineer and working for bank I am not trying to do anything to destroy my life or make it harder on me.. I had no idea or did I invite my mechanic to the complex it was a misunderstanding on his part!

Please im in need of assistance!!

this is what the eviction notice states "Drug dealer friends on property tuesday, september 8, 2009. Attempted assault of a peace officer while distributing drugs on the property."

You need to research Texas law. You have internet access obviously.

Perhaps someone here knows Texas law and I hope they assist you.

Generally speaking, there is no such thing as a 24 hour eviction notice. They still have to go to court and get a court order of eviction. You deserve to be able to defend yourself from these allegations. You can't be evicted on the basis of someone's allegations. It isn't even your conduct other than having a bad friend. It makes no difference if you are on a month to month tenancy or a lease. Your posiition is enhanced if there is a lease.

If anyone enters your apartment and tries to remove your property, first have them arrested for breaking and entering and trespass. Then sue them into the ground.

Did you go to the eviction hearing and present your side of the story?

If by hearing you mean go to the front office and speak with them than yes..
they did not arrange the meeting, the day we got evicted I went up there with my mother

they kept saying that because on his statement he said he was my friend picking me up that hes my responsbility.

They are trying to make me pay $600 fee or reletting the apartment and a $1300 fee for not giving 60 day notice of breaking the lease and also pay rent until they lease out the apartment to someone else... DO you think this situation is worth fighting for and should be taken to court if necessary?

YES! would be my answer. Apparently they never went through court w/eviction or anything. ALOT of places try to make tenents believe they can evict you on their whim & intimidate people so the people take their word for it, and do nothing about it. I would definitly look into doing something.
