    Default Received Discovery

    I received my requested discovery documents today, but I only received a copy of the original ticket, and the "Speed Measuring Device infraction Affidavit"

    The orginal copy of the ticket has the SMD checked, but on my copy of the ticket that the deputy issued me, the SMD is not checked. Would that be grounds to dismiss the infraction?

    My suggestion is to contact the Clerk of the Court to see if they can send you a copy of the Calibration Certificate for SMD #36294. I find it very interesting that the officer does NOT list the make and model of the SMD, nor the serial numbers of the tuning forks he used to check the unit on the day of the infraction. There was a thread here a while back where the serial numbers of the forks shown on the ticket did not match the serial numbers on the Calibration Certificate. That one got dismissed.

    Anyway, I think it's worth pursuing.
