Default California DMV Delay Caused Loss of Auto Insurance and $1300 Balance Towards My Auto

My question involves a consumer law issue in the State of: California

I received a letter in 6-09 from California DMV for a simple renewal of driver license. June 22 about 3 weeks prior to the "expiration" (7-8-09) I posted a payment of $118 towards the renewal on the official DMV website. Payment was collected and stated DMV will take about 10-15 days to receive my new DL.

In late July my 6 month auto insurance renewal was approaching. With the renewal came a few usual requests for signatures and a copy of my current DL. It's almost August and I have yet to receive my DL so my auto insurance company gave me another week to send in a copy of my new DL. Now Im driving with no DL and no insurance! Scary i know but How else am I going to make it to work?!?!

A week passed and still no renewed DL. I decided to call which was worse then trying to get a hold of the President. Finally got through and was told my payment was collected and it would take about 30 - 60 days to receive my DL. I explained my auto insurance issue and in there own words "it wasn't their issue". I requested some type of proof showing that I have a valid DL in-order to renew my AI. They wanted more money and another 2 week wait to receive Proof of DL.

I just received a letter from my bank stating that I have no insurance on the vehicle so as lien holders they have to provide coverage which resulted in $1300 added to my loan.

Its been well over 60 days still no DL, No insurance on truck , and now paying $1300 more on my loan.

So pretty much paid DMV of California $118 to be put in this bind when all i did was what I was suppose to do?!?! Any help or advice would greatly be appreciated!!!!!!!!!!!!!!!!!!! Thank you for reading

I was not aware of a license being required to obtain insurance on your own vehicle. Obviously they would not insure it against your liabilities should you drive it without a valid license but you should have been able to obtain insurance.

and did you ever simply go to the DMV and request proof of a valid license rather than doing everything via phone or internet?

    Thanks JK

I'm actually living out of state so going into the DMV is out of the question... Considering it is a renewal of auto insurance for 6 months they need proof that I am legal driver in the state of Hawaii regardless of state issued DL. ughhhhhhh-

if you are living out of state, why are you even attempting to obtain a California license? I would have to look but most states require you to transfer you license to their state within 30 days of establishing residence there unless you are military..
Maybe that is why the problem with your license. They are having a problem sending it to Hawaii instead of the address on the license.

and the problem comes with the ; prove you are the legal driver. Well, you aren't so you find somebody that can drive the car legally and list them as driver until such time you can legally drive again.

Why is the renewal fee for YOUR driver license $118? Last I checked, they were $28. So what else is missing from this story that makes your license so expensive?

Not military but keeping my california residency for school purposes back home. Im currently receiving all california mail at my permanent address in california so that cannot be causing any delays. The DMV has no info that i am no longer in the state. For all they know I'm in California.

I guess being organized isn't enough! I always read whore stories like mine and think wow- Now I'm on this side!!!! Thanks for the replies JK! I'll be checking back through out the day. Going to charge North Shore Oahu. Waves are pumping and need to cleanse this stress off! IM NOT DRIVING though! smirk face

So, is somebody collecting the mail at the address you use so as to illegally defraud California or am I misunderstanding your intent?

Either you are a Hawaii resident or a California resident and need to obtain the proper licenses and vehicle registrations. If you are actually a resident of California simply attending school in Hawaii, that is a quite different situation.

The odd thing; I have never been asked for a NEW copy of my license to renew a policy or actually, to even purchase a new policy. In fact, I have never provided a copy of my license at all for insurance. They wanted my license number, which they could then use to verify my status.

So, is your truck registered in Hawaii?
So, if the truck is registered in Hawaii, an insurance company knows you are to have a Hawaii license and as such, you cannot be the legal driver with a California license since you cannot have a vehicle titled in Hawaii unless you are a Hawaii resident and if you are claiming California residency, your truck needs to have a California title and registration.

I simply believe your house of cards is beginning to fall.

I am still a california resident considering my stay here in Hawaii is temp. My truck is registered here in Hawaii and never had to gain a HI DL in-order to register it or gain an insurance policy. My CDL was good enough. My home address in California is my mothers home where i was born and raised and she simply forwards my mail to my temp address here in HI. I am a registered voter in the state of California and I continue to pay California State taxes. The company I work for is based in California and was relocated temp for training purposes. I am also a student completing courses online from a california state school which was suggested by my school counselor prior to my TEMP move to HI to avoid paying out of state tuition to HI. NOT DEFRAUDING IN ANY WAY

When time came to renew my auto insurance on my vehicle here in HI (which i shipped from CA and registered it with in 15 days of being on the island) they needed a copy of my DL regardless of which state it was issued in. Back in CA i never had to show my CDL just my CDL number like you mentioned yourself. I had to show my DL when i started my policy and now when trying to renew it. Guess thats something they do different here?!?!But back to the real issue here.. THE DMV

DMV has not sent my new drivers license and continue to give me the run around when i call. They have received payment and shows in their system that it is in process. I'm suppose to be receiving it 30 - 60 days... Its been over 60 days!

    California- What is going on?!?!?!?!

House cards are still standing tall

I'm still wondering why your license renewal was $118?

    so, a real easy question:

how long have you been in Hawaii and when are you returning back to California?
