My question involves divorce in the State of: North Carolina NC
I have been married for ten years to an Indian citizen who has a green card. He has now returned to his home country and has no plans to come back to the USA.
We signed a separation agreement three years ago, where it is established that I get to keep the house and pay the mortgage, and he is supposed to do everything required to get the deed transferred to me. I never got a divorce, as we were back together on and off and kept close. But now he is gone for good, apparently with the intent of marrying somebody in India because his family wants him to have children in his home country (we have no children).
I am now very concerned about being able to get title of my house. Can I get the deed transferred to my name only using the S.A.? Is it necessary for him to come back to the USA to to finalize a transfer of the house deed? And if it is necessary for him to be here, and he refuses to come, what can I do? Am I going to get stuck paying a house and never be able to really own it??? This is so nerve wrecking, please help!!!
