    Default Co-Signer Trying to Avoid Garnishment

    My question involves an auto loan or repossession in the State of: CA

    I was trying to be a good person and help out a friend when she needed a car. Because her income was so low, I was asked by her and the dealer to help since I earn more income and have stability on my job. I ended being named as the primary and my friend the secondary. My "friend" assured me she was going to be responsible for the loan and I didn't need to worry. Well, barely three months after the car was repossesed. She is not making any effort to bring the loan up to date.

    Although I look good on paper, I am living paycheck to paycheck and raising two kids on my own. I am terriefied my paycheck will soon be garnished. There is no way I can afford to pay for this other car. If we go to court can I ask that my friends check be garnished for a higher percentage of the amount due? Can I sue her for any wages I lose? Thanks.

    You put yourself in a terrible position. They finance company will sue whomever they feel they can collect from. You will not be given the "opportunity to ask that your friend be garnished at a higher rate than you." Since you have a higher income stream, you will be affected the most.

    My suggestion to you is to sue your friend.

    Thank you for the answer. What are the chances I will win my suit against my "friend" when I sue her for lost wages? Is it a long process? What type of law suit is this called?
